As a bank trying to deal with the problem of notes backed by real estate that are sub or non-performing, your options are pretty limited.  You can try to sell them in a pool to the hedge fund sharks that are always calling and offering twenty cents on the dollar. Or you might be able to sell them with still performing loans individually to other banks or a select list of highly qualified investors, but again, at a terrible discount.

Finally, the FDIC may be giving you little time or choice by mandating a higher capitalization requirement, changing the allowable asset limits in loan classification categories and by telling you that despite published capitalization guidelines, you only have 90 days to comply or the FDIC will ‘assist’ you in finding a buyer for the bank’s assets.
